Guest Terms, Conditions, and House Policies

PROPERTY ACCESS
We will provide your arrival information two weeks prior to your arrival, or sooner if you are arriving within that timeframe. Check-in is at or any time after 4:00 PM and check-out is before or by 10:00AM
* Early check-ins and late check-outs, in all cases, require prior approval and are subject to additional fees.

CANCELLATION POLICY:
1. To receive a full refund, guests must cancel at least 30 days before check-in
2. Bookings canceled at least 14 days before the start of the stay will receive a 50% refund.
3. For a cancellation notice received more than 14 days before the check-in date, a refund will not be issued, other than the departure cleaning fee.
4. This loss can be avoided if Travel Protection Insurance was purchased, and the reason for cancellation is covered under the travel insurance policy. All reservation changes must be acknowledged in writing.
5. Owner/Agent Cancellation Policy: In the unlikely event that the Property becomes unavailable for any part of the tenancy, Owner/Agent reserves the right to cancel the reservation. Such reasons may include, but will not be limited to, unforeseen repairs, service, maintenance, or any other reason the Owner/Agent deems necessary. Owner and/or Agent may cancel this Agreement and refund in full to the Guest all payments made. The agent will assist in procuring similar alternative accommodation should this situation arise. Guest agrees that any claims against Owner/Agent arising out of performance or non-performance under this agreement shall be limited to a full refund of all consideration previously tendered by Guest.

TRAVEL INSURANCE
Quam Properties Hawaii upholds a strict cancellation policy, so we strongly encourage protecting your vacation investment by obtaining travel insurance in the event of unforeseen circumstances.

NATURAL DISASTER / HURRICANE POLICY
No refunds or date changes will be given for hurricanes and/or storms. We strongly recommend purchasing travel insurance.

POWER/WEATHER-RELATED CONDITIONS:
Quam Properties does NOT issue refunds due to acts of nature such as: weather, road conditions, hurricanes, power outages, etc., but Travel Protection Insurance does provide some protection against these instances. If the property is uninhabitable due to such circumstances and you did not purchase insurance, reservations can be rescheduled for future dates within one year of the reservation date.

RATES
All properties we manage are individually owned. Rates and minimum stays may vary. Quam Properties Hawaii, Inc. reserves the right to change quoted rates before confirmation of the reservation. Rates are subject to change without notice. Quam Properties Hawaii reserves the right to run last-minute specials and/or promotions to fill empty dates. Existing customers who already have a booked reservation are not eligible for last-minute specials. Cleaning fees will be added to all stays.

TAXES AND REGISTRATION FEES
State of Hawaii Transient Accommodations Tax (11%), General Excise Tax (4.167%), and Maui County Transient Accommodations Tax (3%) are charged on all reservations. Resort Fees may apply and are not affiliated with Quam Properties Hawaii.

PROCESSING FEE
Reservations are automatically charged a 5% processing fee on the booking total.

DAMAGE PROTECTION
Guests agree to abide by all house rules. Property Damage Protection covers unintentional damage to the rental unit interior that occurs during your stay, provided it is disclosed to management before check-out. The policy will pay a maximum benefit of $1,500. Should damage exceed $1500 all damages or missing items caused by the guest will be the responsibility of the guest to repair, replace, or reimburse. Should the owner have to sue for damages, the guest will be responsible for all court costs, damages, and attorney fees will be charged to the credit card on file. If, during your stay at one of our Rental Properties, an Insured Person causes any damage to the real or personal property of the unit because of inadvertent acts or omissions, the Insurer will reimburse the Insured for the cost of repair or replacement of such property up to a maximum benefit of $1500. Certain terms and conditions apply. Guests agree to abide by all house rules. All damage or missing items caused by the guest will be the responsibility of the guest to repair, replace, or reimburse. Should the owner have to sue for damages, the guest will be responsible for all court costs, damages, and attorney fees.

MAID SERVICE
Daily maid service is not included in the rental rate. Housekeeping services are provided at an additional cost. All rentals are clean and stocked with linens and starter supplies but not replenished. Starter supplies include laundry soap, dishwashing soap, dishwasher detergent, paper towels, toilet paper, tissue, bar soap, shampoo and hair conditioner, and trash can liners.

NO SMOKING
Smoking is not permitted within the condo, the lanai (balcony), and/or patio areas. A $400 fee will be assessed if there is evidence or remnants of smoke in the condo. Under Hawaii State Law smoking is prohibited in any public places. The law also prohibits e-cigarettes and other electronic smoking devices in these areas. Smoking is also banned within 20 feet of entrances, exits, and operable windows in these locations. {{initial}}

CONSTRUCTION NOTICE
Most of our properties are in condo-type complexes that sometimes require common element maintenance. The type of maintenance and maintenance schedules are out of control of Quam Properties Hawaii. We apologize for any inconvenience of such maintenance projects that may occur; however, guests will NOT be given any type of refund or credit.

FAILURE OF A SYSTEM, AMENITY, OR APPLIANCE
In the event, that the complex sustains a failure of a system, amenity, or appliance – including but not limited to water, sewer, electrical, internet, A/C, TVs, cable service, refrigeration, pool, laundry equipment, electronic or entertainment equipment or service, NO refunds will be given for such failures. However, Quam Properties, upon being notified, will make every effort to promptly repair or replace the failed system. Getting to this remote island can be challenging. Guest understands and accepts that some systems, amenities, or appliances may not always be fully functional, and it may be difficult or impossible to get a system operating within the rental/lease period.

LIABILITY AND DISCLOSURE
Quam Properties Hawaii, Inc. manages properties for individual owners. Each Owner furnishes their property as they desire. Reservations are considered short-term leases/rentals with the individual property owner. Problems rarely occur but accommodation cannot always be controlled. Quam Properties Hawaii, Inc. reserves the right to substitute an alternate accommodation of a similar type up to and including the day of arrival. All reservations are subject to cancellation or change for reasons including, but not limited to, strikes, acts of God, failure of guests to vacate as scheduled, owner occupancy, and sale of properties. Deposits will be held in client trust accounts, and any interest earned shall become the property of Quam Properties Hawaii, Inc. Terms and conditions are subject to change without notice.

MAXIMUM GUEST OCCUPANCY
Individual unit maximums may vary. Children under 2 years of age do not apply to the guest count.
